WHAT IS FSSAI?

As per the Act, no person shall commence or carry on any food business except under a FSSAI license or FSSAI registration. Therefore, everyone is required to obtain a FSSAI License or Registration for food manufacturing or processing or packaging or distributing.
Food Safety and Standards Authority of India (FSSAI) is an autonomous body established under the Ministry of Health & Family Welfare, Government of India. The FSSAI has been established under the Food Safety and Standards Act, 2006 which is a consolidating statute related to food safety and regulation in India.

TYPES OF FSSAI FOOD LICENSE

As per the Act, no person shall commence or carry on any food business except under a FSSAI license or FSSAI registration. Therefore, everyone is required to obtain a FSSAI License or Registration for food manufacturing or processing or packaging or distributing. On the basis of application and supporting documents, FSSAI will accord approval and applicants are given a 14-digit FSSAI Registration Number.
It is mandatory for all the Food Business Operators (FBOs) in order to obtain an FSSAI license or Food Licenses. There are different types of fssai food license.

  • Central License
  • State License
  • Basic Registration

The three licenses, however, differ on the basis of the scale of operation of the food business which is being carried out.

  1. FSSAI Registration Central License: Food business operators such as the Importers, 100% Export Oriented Units, large manufacturers, operators in the Central Government agencies, airports, seaports etc are however required to obtain a Central Food License. It is for the units who are having an annual turnover which is greater than 20 crores. The maximum tenure of this license is 5 years and the minimum is 1 year. The Central license is issued by the Central Government.
  2. FSSAI Registration State License: business operators like small to medium-sized manufacturers, storage units, transporters, retailers, marketers, distributors etc. whose annual turnover of more than 12 lakh are required to obtain the FSSAI State License. The State License is issued by the State Government and it is important that you have operations in only 1 state. The maximum tenure of this license is 5 years and the minimum is 1 year.
  3. FSSAI Registration: The Food business operators like petty food manufacturers and also the small-sized manufacturers, storage units, transporters, retailers, marketers, distributors whose annual turnover is up to 12 lakhs are thus required to obtain the FSSAI Registration. The FSSAI Registration is however issued by the State Government. The maximum tenure of this license is 5 years and the minimum are 1 year.

DOCUMENTS REQUIRED FOR OBTAINING FSSAI REGISTRATION-

  1. Form B – completed and signed
  2. Photo Identity of FBO
  3. Proof of possession of premises (eg. Rental Agreement)
  4. Partnership Deed / Certificate of Incorporation / Articles of Association etc
  5. List of food products to be dealt with
  6. Food safety management system plan

The Documents Required for Central License –

  1. Form B duly completed and signed
  2. Plan of the processing unit.
  3. List of Directors/ Partners/ Proprietor with address, contact details, and photo ID
  4. Name and list of equipment and machinery used with the number and installed capacity
  5. List of food category to be manufactured
  6. Authority letter from manufacturer nominated a responsible person name and address
  7. Analysis report of water to be used in the process to confirm the portability
  8. Source of raw material.
  9. Ministry of Commerce Certificate for 100% EOU
  10. NOC/PA document issued by FSSAI
  11. IE code document issued by DGFT
  12. Form IX
  13. Certificate from Ministry of Tourism
  14. Proof of possession of premises
  15. Partnership deed/ affidavit of proprietorship
  16. NOC and copy of License from the manufacturer
  17. Food safety management system plan or certificate
  18. NOC from the municipality or local body
  19. Supporting document for proof of turnove and transportationr
  20. Declaration form

The Documents Required for State License -

  1. Form B duly completed and signed
  2. Plan of the processing unit.
  3. List of Directors/ Partners/ Proprietor with address, contact details, and photo ID
  4. Name and list of equipment and machinery used with the number and installed capacity
  5. List of food category to be manufactured
  6. Authority letter from manufacturer nominated a responsible person name and address
  7. Analysis report of water to be used in the process to confirm the portability
  8. Proof of possession of premises
  9. Partnership deed/ affidavit of proprietorship
  10. NOC and copy of License from the manufacturer
  11. Copy of certificate obtained under the Coop Act 1861/Multi state Coop Act 2002
  12. Food safety management system plan or certificate.

GUIDELINES FOR USING FSSAI LICENSE NUMBER

The Brand owner shall display the FSSAI logo and his license number on the label of food package.
In case of imported food products, the importer shall display FSSAI logo and license number along with the name and address of importer on a sticker to be affixed before customs clearance.
