Shops & Establishment Act

Shops and Establishments Act in India have been enacted by the states to regulate conditions of work. Additionally, it provides the statutory obligations of the employers and right of the employees in the un-organized sector of employment. It is an Act to amend and consolidate the law relating to the regulation of hours of work, payment of wages, leave, holidays, terms of service and other conditions of work of persons employed in shops, commercial establishments, establishments for public entertainment or amusement and other establishments for matters connected therewith or incidental thereto.

Applicability of the shops and establishments act

  • Retail or wholesale shops.
  • Store-rooms, god owns, and warehouses.
  • Residential hotels.
  • Theatre or any other place of public amusement or entertainment.
  • Premises from where services are provided to customers.
  • Any other place of work.
  • Restaurants or eating houses.

Documents Required for Registration for Companies/LLP/Partnership/Individual

  • PAN card of Company, PAN card of LLP/Partnership Firm, PAN card of Proprietor as the case may be.
  • Documents of the Directors/partners/Proprietor: PAN card + I.D. proof such as Passport, Driving Licence, Voter Card, Aadhar Card is acceptable + address proof as Electricity Bill, Telephone Bills and other utility bills.
  • Certificate of Incorporation of Company, Certificate of Incorporation of LLP or Registration copy of Partnership deed as the case may be
  • Memorandum and Articles of Association of the company.

RECORDS TO BE MAINTAINED UNDER THE ACT

Under the Shop and Establishment Act, every business has to keep up-to-date registers regarding details of employment, fines, deductions and advances, salary and holidays. The requirements may vary from state to state.

When is a Shops and Establishments Act license required?

Every shop and establishment need to register itself compulsorily under this Act within 30 days of commencement of work.
